[edit] Meetings and Minutes

Meeting Dates:

Summary of Sept. 21 Email Communications

Summary of Oct. 1-14 Email Communications

October 27th, 7:30pm, Beatley Library

This meeting lasted 2 hours. We did preliminary copyright analysis on the items in the copyright database, and identified items needing more research inside the Simmons archive as well as research needed for institutions outside Simmons. The committee solidified our schedule for the rest of the semester with the short term goal of finishing copyright analysis and composing copyright statements, and for the rest of the term compiling our research into a white paper by the end of the semester.

[edit] Copyright Database

We have finished the copyright database and have detailed each item in the scrapbook. Copyright Database

Database Key for Risk Assessment

Due to the age of the scrapbook, we don't think that there are any items that are "high risk" for our project.

red = medium risk

light blue = low risk

light green = no risk - (c) Simmons College

gray = no risk - probably public domain (or a three dimensional object)

Here is the final PDF version. Media:Copyright Database - Hering Scrapbook.pdf

Warning Concerning United States Copyright Law

The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law.

Notice and Procedure for Making Claims of Copyright Infringement

If you believe this site is infringing your copyright, the Archives will take appropriate actions under the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c)(2) (“DMCA”). Pursuant to DMCA, written notification of claimed copyright infringement may or should be submitted to the Simmons College Archives.

[edit] Copyright Links and Resources

Cornell has one of the best (and easiest to understand!!) websites concerning copyright.

Section 108 of the US Copyright Law is the exemption for Libraries and Archives. This exemption allows for the reproduction and distribution of material for educational purposes and private study. However, please note the Copyright Act was written in 1976, before the age of digitization. It was slightly altered in 1998 with the Digital Millennium Act but does not include electronic resources.

In response to the need to include new technologies in the Copyright Act, the Section 108 Study Group formed in April 2005 to help draft new legislation to update Section 108 to include the special concerns surrounding digitization. Their report was released in March of 2008. Pages 113-116 refer to "virtual libraries" (as well as the concept of "virtual-only libraries").
